Content Usage Permission Agreement

Thank you for sharing your Zoomax story.

This Content Usage Permission Agreement (“Agreement”) explains how Zoomax (“Zoomax,” “we,” “us,” or “our”) may use the story, photos, videos, and other materials you submit through the Share Your Zoomax Story program (“Program”).

By submitting your content and checking the agreement box on the submission form, you acknowledge that you have read, understood, and agreed to the terms below.

1. Eligibility

You confirm that:

  • You are 18 years of age or older.
  • You are submitting content featuring an eligible Zoomax product.
  • You have the legal right and authority to submit the content and grant the permissions described in this Agreement.

2. Content Submitted

For this Agreement, “Content” includes any materials you provide to Zoomax through the Program, including but not limited to:

  • Photos
  • Videos
  • Written stories or descriptions
  • Your name or other information you choose to provide with your submission
  • Your image, voice, likeness, or appearance shown in the submitted materials

3. Permission to Use Your Content

By submitting your Content, you grant Zoomax and its affiliates, employees, contractors, marketing partners, and service providers a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, distribute, edit, modify, adapt, and create derivative versions of your Content for marketing and promotional purposes.

This permission includes use on:

  • Zoomax official websites
  • Social media platforms
  • Email marketing
  • Digital advertisements
  • Promotional campaigns
  • Other online or offline marketing materials

Zoomax may use your Content in its original form or may edit, crop, resize, combine, or adapt it for different promotional formats.

4. Name, Image, and Likeness Release

You authorize Zoomax to use your name, image, likeness, voice, and other identifying information that appears in connection with your submitted Content for the purposes described in this Agreement.

You understand that your Content may be viewed by the public when used in Zoomax marketing channels.

5. Ownership of Your Content

You retain ownership of your original Content.

This Agreement only grants Zoomax permission to use your Content for the purposes described above. It does not transfer ownership of your photos, videos, or written materials to Zoomax.

6. Your Responsibilities and Rights

By submitting Content, you confirm that:

  • The Content is your original work or you have obtained all necessary permissions to submit and authorize its use.
  • You have permission from any other person appearing in your photos or videos to allow Zoomax to use their image, likeness, or appearance.
  • Your submission does not violate the copyright, privacy, publicity, or other rights of any third party.

If your submission includes another individual, including family members, friends, caregivers, or other people, you are responsible for obtaining their permission before submission.

7. Amazon Gift Card

Eligible participants who submit required materials and grant Zoomax permission to use their submitted Content may receive a $50 Amazon Gift Card as a thank-you for their contribution.

The gift card will be sent electronically to the email address provided during submission after the submission meets the Program requirements.

The gift card is provided for your participation and contribution of Content, not for providing a specific opinion, rating, or positive review of Zoomax products.

8. No Obligation to Publish

Submitting Content does not guarantee that Zoomax will publish or use your Content.

Zoomax may determine how and where submitted Content is used based on its marketing needs.

9. Release and Limitation of Claims

To the extent permitted by law, you release and agree not to hold Zoomax responsible for claims arising from the authorized use of your Content as described in this Agreement.

This includes claims related to the use, publication, display, editing, or distribution of your submitted Content in accordance with this Agreement.

10. Privacy

Information collected through this Program will be handled according to Zoomax’s Privacy Policy.

11. Changes to This Agreement

Zoomax may update this Agreement from time to time. Any updates will be posted on this page with a revised “Last Updated” date.
